European Union Legislation

Since the accession of the Republic of Croatia to the European Union (EU), all EU regulations apply in the Republic of Croatia, and take precedence over national legal provisions. EU regulations are divided into three related systems: primary and secondary legislation as well as court decisions.

Primary Legislation

The founding treaties, their amendments and supplements are part of the legislation of the European Union, which has the significance of the constitution and represents primary legislation or primary law.

In addition to the founding treaties, an integral part of primary legislation are international treaties and conventions (agreements) concluded jointly by the European Union and the Member States or independently by Member States with third parties. The institutions of the European Union were established on the basis of the founding treaties.

The basic act of the European Union in the field of peaceful use of nuclear energy is the Ugovor o osnivanju Europske zajednice za atomsku energiju  (EURATOM) , signed on 25 March 1957 in Rome.

Secondary Legislation

Secondary legislation covers legal acts adopted by the institutions of the European Union within the competences conferred on them by the founding treaties. Secondary legislation is not only determined by the provisions of the founding treaties, but is also established and developed on the basis of the experience of the Court of Justice of the European Union.

Legal acts of secondary legislation are: Regulations, Directives, Decisions, Recommendations and Opinions.
